Jefferson County To Receive $575,000+ In Appellate Court Reversal Decision

“We are pleased that the court of appeals ruling will stand and the school system, and especially the tax payers of Jefferson County, will see this money returned to our district so that it will benefit the students of Jefferson County.” - Dr. Johnston

In July 2013, the Jefferson County High School campus experienced a roof collapse in a building known as Building 8. Following this roof collapse, the Jefferson County School District filed lawsuit against Travelers Insurance in an effort to obtain restitution for the damage caused by the roof collapse. This was the Jefferson County School’s response to the disagreement over the liability and responsibility for damages at the Jefferson County High School campus.

Originally the trial court sided with Travelers Insurance, but that decision was overturned by the Court of Appeals earlier this year. Travelers Insurance subsequently filed a motion for appeal with the State Supreme Court.

Last week the Tennessee Supreme Court refused to consider the current case between Jefferson County Schools and Travelers Insurance concerning Building 8 on the campus of Jefferson County High School.

As an update, the court of appeals reversed an earlier trial court and awarded Jefferson County a judgment of over $575,000.00.

With the refusal to hear the case by the Supreme Court, the case will now go back to trial court with instructions to enter an order to that effect. The trial court will have to determine the amount of interest and costs that should be awarded in addition to the amount for damages listed above.
