NOTICE OF TRUSTEE’S SALE

  WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Promissory Note dated July 21, 2015, and the Deed of Trust of even date securing the same, recorded July 22, 2015 in Book 1275 at Page 327 in the Office of the Register of Deeds for Jefferson County, Tennessee, executed by David K. Curl, conveying certain real property therein described to Larry R. Churchwell, as Trustee for Peter Johnson and Celia Johnson; and the undersigned, J. Michael Clement, Esq., having been appointed Successor Trustee by Peter Johnson and Celia Johnson.

  NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that J. Michael Clement, Esq., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee by Peter Johnson and Celia Johnson, will on the 13th day of November, 2019, at 10:00 a.m. at the Jefferson County Courthouse, 202 West Main Street, Dandridge, Tennessee, offer for sale certain property hereinafter described to the highest bidder for certified funds paid at the conclusion of the sake, or credit bid from a bank or other lending entity pre-approved by the Successor Trustee. This sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Jefferson County, Tennessee, and being more particularly described as follows:

  SITUATE in the THIRD (3rd) Civil District of JEFFERSON County, Tennessee, and being more particularly described as follows:

STARTING at a point which is the common corner to the western side of White Birch Road and the northern side of Beth Carr Road and Long; thence North 38° 24’ East 56.3 feet to a new iron pin which is the POINT OF BEGINNING; thence along a new line South 54° 28’ West 151.47 feet to a new iron pin; thence along a new line 65° 28’ East 146.86 feet to a new iron pin; thence along the western edge of White Birch Road South 38° 24’ East 100 feet to the POINT OF BEGINNING, containing 0.386 acre, more or less, according to survey of the Raymond Long Property dated July 9, 1992, by Billy G. Knight, TN RLS #1375, whose address is PO Box 13, White Pine, TN 37890.

THERE IS ALSO CONVEYED BY THIS INSTRUMENT a 30’ easement from Beth Carr Road as set out at Deed Book 721, Page 732, Register’s Office, Jefferson County, Tennessee.

THERE IS ALSO CONVEYED BY THIS INSTRUMENT and granted herewith from the Grantors to the Grantee and his heirs and assigns, the right to purchase water from the well which is on the property adjacent to the property herein conveyed, which well the Grantors agree that they, and successors and assigns, will maintain and provide water to the Grantee herein, his heirs and assigns, for the sum of Ten Dollars ($10.00) per month for so long as the well is in existence, of record in Deed Book 366, Page 236, Register’s Office, Jefferson County, Tennessee.

BEING the same property conveyed to David K. Curl by virtue of a Warranty Deed from Peter Johnson and wife, Celia Johnson, dated July 21, 2015, of record in Inst. Book 1275, Page 325, Register’s Office, Jefferson County, Tennessee.

SUBJECT to right-of-way Birch Road.

SUBJECT to an Oil and Gas Lease dated September 02, 1982, of record in Misc. Book 54, page 114, Register’s Office, Jefferson County, Tennessee.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; any to any matter that an accurate survey of the premises might disclose. In addition, the following parties may claim an interest in the above-referenced property:

JEFFERSON COUNTY, TENNESSEE FOR DELINQUENT TAXES OWED FOR TAX YEARS 2017 AND 2018

The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time. The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above.
